GENERAL
1. This website at courses.protoinnovation.co ("Site") is a website where you can browse, select and order products advertised on the Site. The Site is operated and managed by Proto Innovation Consulting Pty Ltd ("Proto Innovation"), ABN 38 653 434 621.
2. These terms and conditions apply to all transactions you enter into with Proto Innovation and by accessing, use of, or placing an order through the Site, you agree to be bound by and comply with these terms and conditions (including our privacy policy).
3. We attempt to be as accurate as possible on our Site but this does not in itself warrant, that any information provided on the Site, including in relation to product descriptions or other content of this site, is accurate, complete, reliable, current or error-free.
REGISTRATION OF ACCOUNT
1. For individual customers, you must be aged 18 or older to register an account on the Site. For business customers, you must be a company, partnership or ABN holder. You must not attempt to become a customer or obtain an account if you do not meet these criteria (“Registered Member”).
2. You must complete the customer registration process through the Site to become a Registered Member. Any personal information that you give us will be held and used by us in accordance with our Privacy Policy.
3. Your account is non-transferable. You may update, edit or terminate your account at any time by contacting our customer service team.
4. When registering for an account on the Site, you will need to provide all relevant details, including contact information, delivery address, and payment details as required.
5. Once you have been successfully registered, you will be issued with a password to access your online account. You are solely responsible for maintaining the confidentiality of your password and you may update or edit your account at any time through the Site or by contacting our customer service team.
6. You may be refused an account or orders at our sole discretion.
7. We may in our sole discretion terminate your account or services at any time.
PLACING AN ORDER
1. You may place an order as a Registered Member by selecting and submitting your order through the Site.
2. Any order placed through this Site is an offer by you to purchase the selected products at the price notified (including the delivery and other charges and taxes) at the time you place the order (“Order”).
3. When placing an Order, you agree to provide us with current, complete and accurate details.
4. You are solely responsible for reviewing your order confirmation and must advise us immediately if you believe there are any product or pricing discrepancies.
5. We reserve the right to accept or reject your Order for any reason, including if the requested product is not available, if there is an error in the price, if the product description posted on the Site is incorrect, or if there is an error in your Order.
6. If an Order placed through the Site is rejected, then Proto Innovation will endeavour to notify you of that rejection at the time you place the Order or within 48 hours after you submit your Order.
CANCELLATION OF ORDERS
1. We may cancel any Order or part of an Order (including any Orders that we have accepted) without any liability to you for that cancellation at any time if: (a) the requested Products in that Order are not available; or (b) there is an error in the price or the product description posted on the Site in relation to the relevant product in that Order; or (c) that Order has been placed in breach of these terms and conditions.
2. If we cancel an Order in accordance with we will not deliver your Order and provide you with reasonable notice of that cancellation, and will not charge you for the cancelled Order. If any payment has been taken for the cancelled Order, then the full payment amount, including any other fees and charges, will be refunded to your original payment method or through an alternative means.
3. You may cancel an Order (whether it is accepted by us or not) by emailing us at [email protected] within 7 days of your original order date. No fees or charges will apply to that cancellation upon acceptance of cancellation within 7 days. Accepted cancellations of an Order after 7 days are subject to cancellation fees equivalent to 50% of the total order price. Order cancellations will not be accepted after 30 days.
FEES AND CHARGES
1. We will charge you, and you agree to pay, the following fees and charges in relation to an Order that we accept (as applicable): (a) the purchase price of each Product that is ordered; and (b) the cancellation fee for an Order that is cancelled as set out in (Cancellation of Orders) section, plus any other fees and charges set out in these terms and conditions.
2. You acknowledge that we are not required or obliged to match any prices for any Products.
3. You acknowledge that prices for Products change from time to time and we do not provide any notice of these changes. Subject to these terms and conditions, once we have accepted your Order, we will not change any prices that apply to the Products in that Order.
4. If a Product that you have ordered is not available and we have not provided you with a substitute then we will provide you with a refund back within 3-5 business days to your card of purchase to the value of the Products (excluding delivery) that were not supplied to you.
PAYMENT METHODS
1. You must pay the fees and charges online using the online payment methods. We accept the following credit cards: Visa and Visa Debit; MasterCard and MasterCard Debit; American Express; PayPal.
2. If we are unable to successfully process your payment for your Order that is accepted by us, then we may notify you of dishonour and cancel your Order.
3. You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means.
RETURNS AND REFUNDS
1. If the product you purchased through the Site is faulty or defective, and you are able to provide full proof of purchase, then we will refund the purchase price or exchange the product (excluding the delivery fee) provided the Product has not been used (in part or whole) and if you have received a physical product, it contains original packaging.
2. We reserve the right to have the product assessed for acceptable quality prior to providing you with a suitable remedy.
3. To make a claim under our Returns and Refund Policy, you must contact Customer Service and return the item to the store. Any cost incurred by you to return the product will be borne by you.
4. If you do not have proof of purchase and you wish to return a faulty or defective product we will provide you with a Credit Voucher to the value of the purchase price, which you can used online within 6 months from the date of issue. In this instance, you will be required to provide identification showing your name, address and signature and these details will be recorded for loss prevention purposes. Your information will be kept in accordance to our Privacy Policy
CHANGES TO TERMS AND CONDITIONS
1. We reserve the right to amend these terms and conditions at any time without notice. Any amendment to terms and conditions will come into effect from the time the amended terms and conditions are posted on the website. If you use this website or place an Order after any amendment, you agree to be bound by and comply with the amended terms and conditions. It is your responsibility to ensure you should read these terms and conditions at the time of Order.
